The current SES regulatory framework comprises four basic Regulations:
- Regulation (EC) No 549/2004 (“the Framework regulation”)
- Regulation (EC) No 550/2004 (“the Service provision regulation”)
- Regulation (EC) No 551/2004 (“the Airspace regulation”)
- Regulation (EC) No 552/2004 (“the Interoperability regulation”)
These four Regulations were amended by Regulation 1070/2009, as part of the SES II package. This was accompanied by the inclusion of ATM in the EASA framework with the adoption of Regulation 1108/2009 extending EASA remit to airports and ATM/ANS. The SES legislative framework also includes a broad set of Implementing Rules as well as Guidance Material published by the European Commission and EASA.
Commission Implementing Regulation 390/2013 (Performance Scheme IR) spells out the detailed requirements pertaining to the application of the SES performance scheme, both regarding the methodology and processes to be followed. It is applied in conjunction with Commission Implementing Regulation 391/2013 (Charging Scheme IR) which governs the setting, collection and enforcement of ANS charges and sets out the determined cost method applicable in connection with the SES performance scheme.
